Divorce & SeparationA wife has appealed the decision of a Judge to reject her divorce petition and claims she is “locked in” to her marriage.

The wife has alleged in her petition that her marriage had irretrievably broken down because her husband’s behaviour was so unreasonable that she could not tolerate to live with him.

She alleged that she was subjected to “continued beratement” and asked the Court to accept that criticising her in front of the housekeeper, rowing with her in an airport shop and not speaking during a meal, amounted to unreasonable behaviour by her husband.

Her husband told the Court that he did not consider the marriage had broken down.  His barrister told the Court:

“At the moment, as the law stands, unhappiness, discontent, disillusionment are not        facts which a petitioner can rely upon as facts which prove irretrievable breakdown.”

Sir James Munby, President of the Family Division, hearing the appeal, said:

“It is not a ground for divorce if you find yourself in a wretchedly unhappy marriage –     people may say it should be.”

Judgment has been reserved.
